Counsels' argument was given in this case this morning. MrPownall said the evidence clearly established a partnership between Brenchley and Bishop. The lease to Brenchley was unregistered, tho latter having given an instrument to Bishop during the currency of tho lease. Notice had been given by Breuehley, and the rent for a fresh leaso tendered. It was clearly shown by Bishop's correspondence, that he had continued to bo a partner of Brenchley's for some time. The partnerihip was practically determined, and the difference between them was treated by both parties as a debt owing by Brenchley to Bishop. The sub-lease was given only by Brenchley to Bishop by way of security, and Bishop was clearly a tenant of Brenohley, Apart from the fact that the lease had not been registered, Blinkhorne was bound by the covenant to grant n re-lease. Jlr Bunny replied that the term of therigbtof Brenchley had expired. Even if by the covenant this wcro so, the fact of his assignment to Bishop of his interest iii the lease lapsed Bishop was tho only one to whont they wore bound to give a leave, I His Worship considered he could ' not mako tho order asked for, on tho facts stated, However, lie would give his judgment in writing on next Court day.
