The case was one in which a pork butcher, who was not assisted by any other person than his wife, was charged with a breach of the Act, in keeping shop open on Wednesday afternoon, 6th inst. Mr Careiv had decided in a similar caso in Dunedhi, that the wife was an assistant, but Mr Martin put a different construction on tho Act, and held that a wife could not bo be regarded as an assistant, and therefore dismissed tho information holding dofendent was entitled to keep open his shop.
