f Ciikistchukcu, Thursday, The appeal in the case Elmers v. Elmers, was heard yesterday. The wife, it appears, had agreed 011 tho payment by the husband of £3OO, to a separation order, and the husband was, it is alleged, relieved of all the responsibility of maintenance. She sued for maintenance, and Mr! Beetham, S.M., held tho deed of separation afforded no ground of of defence,
Judge Denniston upheld this view, and said the Destitute Persons Act provided that while a woman had a husband able to maiutain her, no contract between parties, could relieve the husband of that duty, j
