Tho old fashioned terms of" larceny," " embezzlement " and " falsepretcuccs" had disappeared, and wevo now comprehended under termoftlio fl thoft," and in this respect he thought the change was a'good one. ; : Ho referred at somo length to section 318 of tho Act defining theft, and explained that tho essence of that offence now practically consisted of converting to one's own use, that which belonged to some one else. Ho made these observations in consequence of the exceptional case appealing on tho list-, viz., a charge by a solicitor against a .man, of snatching up and carrying out of his office, a bill of sale which was in favour of tho man himself. The solicitor, however, lwd a special lieu over the bill, and His Honor pointed out that, it would have—according to the Act-to be made clear that the mail intended to deprive tho solicitor permanently of his interest in the chattel; The same section also dealt with a easo in which a man'was charged.'with fraudontly converting to his own use a clique which lie had found.
