■ In tho action brought by William Skcy Government Analyst, as administrator of his late son E, S. Skcy to recover from the Mutual Life Association £ISOO, the amount of a life policy on the life of E. S. Skcy, Mr. h. D. Bell in opening; tho, caso pointed outthat it was not until today during 25 years of business, that I this company had appeared in Court to contest a claim by an assured person. A very important question from an insurance business point of view was involved in the case—a question which was also important hi matters of ordinary business and commerce, namely whether payment by dishonoured cheque was payment at all? This was tho question for the jury to determine, Mr Bell then related the facts of the case as set forth inthcastateinentof tho claim, and impressed upou the jury that Mr Skcy on being applied to (for the payment of his premium) by Mr Astall said he would take his days of grace. If he (Skcy)had died 'within the days of grace (30) the association would uot—whatever their legal , rights-have contested tlio claim, .Mr Bell submitted that a Life Insurance Company was bound to defend itself from a claim such as this, It was perfectly evident that the premium overdue never was, aud never would have.been paid, had not Skcy been killed on tho loth. Tho policy would have been allowed to lapse, Skey having only paid three quarterly premiums, An insurance company could not carry on business if a person could recover under such circumstances as indicated in this ease, After hearing considerable legal argument, it was agreed that the only question was one of law, and could be determined by His Honour without a jury; who were accordingly discharged, ' Legal argument in tho case will be ' lieard.byHisHonor ,on Friday,
