The case Woodrooffe v. Williams, a claim under the Fencing Act, was called on in the Masterton R.M. Court this morning, MrO. A, Pomiall appeared for the defendant and asked for an adjournment on the ground that an important witnes was not in attendance, It was finally deoided to tako evidence for the plaintifi, to Bave the necessity of witnesses attending twice. The case arises out of a dispute between 6, W, Woodrooffe,owner of section 81)-in the Master ton Small Farm Settlement Block, and Edgar George Williams, owner of section 87 adjoining, regarding n boundary fence between the two, which the plain; tiff wishes to erect and to compel the defendant to share tho cost of. The Court is asked to decide the proper boundary and the kind of fence to be erected. Mr Bunny for complainant, alleged that a fence at present existing is not a proper fence within the meaning of the act, and also if it was it is not on the proper boundary. Technical objections were raited by Mr Pownall as to tho notice to fence served, on the defendant being informal, and also as to the Court's jurisdiction,andsaid if It was con. tended that the fence was not a fence within the meaning of the Act, the Court could not order the removal of something which did not exist, His Worship decided to hear the facts of the case. A, J.
