MASrERTM-FRIDAY. (Before Mr T. Hutchison, K.M.) RAnnir case, SMITH V. ANDIiEW. The Rev. J. 0, Andrew was charged on the information of J. W. Smith that he had failed to comply with the provisions of the Babbit Act. Mr Bunny for the informant Mr Andrew for defendant, Mr Bunny said tho information was laid under Section 10 of the Rabbit Act by which the owner of a property was allowed one month after notice to destroy tho rttbhits on bis property. .Due ootico hud been given, but in the opinion of tho informant adequate steps hod not been taken for the proper destruction of the rabbits, in fact it would be shown in evidence that a large portion of ths run had not been dealt with at all.
Frank Ernest Obeli, sworn, stated that he was an agent under tne Babbit Inspector. '. Mr Andrew objected to the evidence of an agent because it was irrelevant. After argument it was decided to hear the inspector first,
J. W. Smith, eworn, stated that he was inspector under the Rabbit Act. The information in question referred to lea station, the proprietor of which was convicted on the sth of May last for having rabbits on his property. One month after the conviction. the property was visited by Agent Orbell, who reported the position of the run bb regards rabbits. Witness-visited the property on the 10th of Juoe. ; The Court adjourned till 2 o'clock.
