done to destroy the rabbits. ■; Agent Butberfurd corroborated the evidence respecting the visits made on the 17th and 18th of April. ■ ■ For the defence Mr Andrew asked His Worship to dismiss the case on the ground that the Chief Inspector was the only person authorised to lay any information. under tbo Act of 1890,,.:Th0 present informaut waß only' a sub-Inspector, and therefore he had no power to sue, also that the interpretation clause of the Act was misleading. His Worship ruled that the evid-
once showed that Mr Smith bad been acting in the capacity of Inspector under the Act of 1882, and therefore be considered he was authorised to lay the information. He also thought that the objection taken to the inter« pretation clause was too thin and overruled it. He thought thesettlers hero were better acquainted with the | Babbit Act than he was.
John Campbell remembered the 7th of April when ho saw Ibe defendant open the notice to destroy rabbits. On that nfteraon tho defendant and wit' nesu went out with guna and doge and gbot rabbits.
By the Bench: Did you shoot any ? Witness: " Yes." Kobert (jco. Staverly said lie was employed at lea for two or three months rabbiting and ferret breeding. Ho had been feijuimtly out ibis month between the 7th and 19th. Heoaught tho rabbits to fcid bis ferrets, Ho bad studied tho question for a long tme and was an expert. He had turned oat foirels since the ninth of the.montb, By Mr. Bunny : His time was occupied in looking alter tho ferrets and nhen lis had found suflioient (20) ralibiis for tho forrots ho came home again, He knew tlfte wore others killing rabbits. Wi-ncaa had put them on at the request of Mr Andrew.
■By the Bench: Ho got twenty rub hiis in about live hours. Had to go about of a mile. Mr Androws quoted Iwm He judgment of Judge Richmond »s regained the opinimof tho Inspector on a " reasonable time."
