BMTCIIFOnD V. MARTIN, _ The evidonco for the defence occupied the Court till the luncheon adjournment. On resuming sovcral witnesses wero called by plaintilFscounsel after which counsel on both sides addressed the jury at some length. After the Judge summed up, the jury retired for a short time and returning said they were linkable to findany damages for the plainHUMHRttund that tho creek was SprnaturaTwater course, and although the flow of water may have increased there was nothing to show tint it was duo to tho action of the defendant. His Honor thcieforc gave judgment for defendant with cost of Court £8 2s, witness' expenses £ 17 7s, solicitor's fee, £8 3s. Tho Court wss then adjourned till Friday at 10 a.m.
