At the trial of Smith, the evidence was produced this morning of the pnsonor'B flalo in Noyeniber, 1890, of the camp gear to a settler in the district, The latter remarked he should want a receipt in case Jacobsen turned up, and put in a claim. Smith said there was no fear of his doing so, Witness men> tioned to Smith he had seen Jacobsen with a largo sum of money, and the prisoner said be was very foolish to show it to people, Tho same witness testified to assisticg in the search at Jaeobseu's camp last X'mas. Ho brw buttons aud a boot toeplato, and also braces metal, taken out of the ashes in the fireplace. Later on au old • p»ur of nluchers wero picked up, which Lt knew to be Smith's by tlio cuts in tho leather. The theory of the prosecutioii is that Smith had only one pair of boots, and when he left helped himself to Jaeobseu's clothes and boots.
