J.P.'s.yeatorday alternoon. Mr lunny appeared for the applicant (Mr Kiddick) and argued at length on the mater, Mr ?owiiall, on behalf of Mr Smith,
ipposet, stating th3t the question bad [ready been dealt with by Mr Price >n a previous occasion, on which Mr punny had agreod to abide by Mr Price'B leoision.

fuiulting tho Bench by insulting one of its justices and had better be careful, Matters cooled down a little and Mr Bunuj read tho sworn affidavits of his client in support ot his application, statluff it was a moat unfair and r.ajuat thing to prevent his clienl obtaining a mi hearing,

After Soaring argument on both sides and careMly weighing the evidence he (Mr PrioeJ'deoided not to grant a re. heating, and in tho face of this the couras Mr Bunny was taking was must unusual, and he should refuse to allow tho case to be reopened. Mr Bunny spoke very warmly on the matter, Mr Pownall replying to certain personalities u.thequal fervour. Mr Renal! thought that in the intorests of justice they might just as well ro-open the case and begin again ik mm. Ho was willing to take this course if bia brother Justice consented. '
Mr Price said tho case had boon dealt with and he would not consent.
Mr Bunny : "I refuse to take any decision of Mr Price o'\ the matter."
Price thon left the Bouoh, and the ca. \ Pago v, Simmons was proceeded with before Messrs Renall and Woodroofo,
