In the Masterton R.M, Court this morning Colonel Eoberts, 8.U., attended to give judgment in the rabbit cases brought by Inspector J, W, Smith against C. F. Vallance, W, W. JohnstoD and 0. J. Jlessrß Beard and Pownall wore present to receive judgments. Inspeotor Smith said he proposeiUo offer farther argument nitjnH Court's permission. " fIH Colonel Roberta said that argument would be to show that the Noi th Wairarapa Rabbit Board waß abolished, or with regard to Inspeotor Smith'a appointment, he might as well state, to savo time, that ho thought the objection raised would be overruled, • Inspector Smith said that under the provisions of seotion 8 of the Rabbit Nuisance Act, 1886, the North Wairarapa Rabbit district had been abolished, the Governor having the power to do bo, and the powers of the Inspeotor again beoame operative under the Act of 1882. grounds, Ho would liko his cases dealt with separately from Mr l'ownall's. Pownall submitted that the abolition of tho Rabbit Board had not been proved. The oxtract put in was neither tho Gazette or a supplemout to it, and it was provided that in order to provo the act ot tho Governor tho Gazette in which it w«a jpjlvertiscd must bo produced, further, if tho Board had been abolished, there was nothiug in tho Babbit Nuisance Aot to authorise tho Inspector again assuming jurisdiction. Mr Beard said a point bad been frequently raised, and overruled by His Worship, viz., tlio point raised by Mr Andrew beforo Judgo Jttiohniond, and he wished to point out that in considering tho presont cases, His Worship was bound to consider and take notice of judicial decisions. Tho effect of Judge Richmond's decision that the Inspector's evidonco could not bo considered conclusivo, Tho samo argumont could be hold to apply to t'lßthreo cases bofore the Court. After furthar argument, His Worship askod if counsol proposed to offer further ovidence if the decisions wero given against them. Messrs Beard aud Pownall iiitimated that they should offer further ovidence. His Worship reserved his decision to considir the question of tho abolition of tho North Wairarapa Rabbit Board.
