SHEARER v. RUNHOOLDER.
[By Telegraph.—Press Association. Asiiburkw, January 19. A caso of interest to ruiiholders am shearers was heard boforo Ca plait Wray, R.M,, to-day, Williams, t shearer, sued MoMilhin, a station owner at Mesopotamia, for £ls damages, suffered by defendant's failuri to fulfil a shearing engngemem entered into with plaintiff whe claimed that McMillan engaged him at Buccleuch to shear at Mesopotamia (a far back Btalion) after Jiuocleuch was cut out. Shearing at the latter was delayed by bad weather, and when plaintiff got to Mesopotamia, a journey of 35 miles, he found tho board full. He asked for compensation but was refused. Defendant said ho engaged plaintiff in tho belief that ho would reach him by December 19th or 21st, Ho waited till the 23rd, and could not wait any longer as ho had not accommodation for the sheep. Five of the eight men engaged at Buccleuch arrived and 25 others never came, A nonsuit was claimed, on tho ground that no price was montioned when plaintiff was engaged. This point and tho decision on tho evidence wero reserved for a week.
