Sergeant McAvdle said that he now wished to substitute a charge of wilful damage to property, a 8 since Smith's detention, he had reason to alter his opinion as to the prisoner's raoutal condition. The Bench permitted the oharge to he mibstiiuted. Accused pleaded guilty. W. Do-all, jeweller, gave evidence of the damage done. Sergeant McArdle said there were a number of petty charts recorded against the ftOCUEed.

Acousctl in reply to the Bench, said Hint ho did not intend to break the window. Ho only hud two glasses of beer. Tho Bench considered the offonco a very serious ono and ordored the accused to pay £5 and costs or in default six weeks hard labour.
