Henry Mason, able seaman on th books of tha Vacuna, late Flyin Soud, was yesterday brought up at th id Resident Magistrate's Court befor Mr Wardell, It.M., charged with rc 'y fusing to work when ordered by tin captain, Mr Lascellcs appeared fo the prosecutor, Thomas C'orlett, ac n cused beingrepreaented by Mr Sheath The mate of the vessel, Thomai Armit, was the first witness called !S He deposed that the accused anc n another man named M'lntyre refused to work on the ICth instant unless flioy had properly- cooked and beltci 11 food provided for them, The men's n dinner was then ready, but the ace cused and M'lnlyre said it to not s fit to cat as it was not sufficiently 1 cooked. Witness' dinner was sufflci- ■ eutly cooked, • In cross-examination tho witness said that the cook might be cleaner in his habits, but he could cook food 1 well, The subslancß produced in ' Court was part of some pudding the > cook had made for the men,' Had the > men eaten that in its half raw state it might have injured tliem. He could have eaten the meat, potatoes, and bread, but the "duff" was heavy, None of the men werp present, so that witness could not ask thppj if llje fopd }io saw wpp what tliey pompliiiped pf, Counsel for accused showed witness specimen, and was asked if ho saw that, The witness replied that he was shown no oheeso, and was then informed that the sp'eoimeu was supposed to be pudding,
t The cook stated that the captain told him to make "plain duff without plums," for the men. The captain had plums in his " duff." The men's " duff" was good to eat, and the mutton they oomplained of was " good enough for any Christian to eat." Witness supposed that the plums were orderadout ofthe men's "duff" to punish them for a row in the morning. The acoused was sentenced to seja» s days' hard labour.—Hawke's SJk Herald. "
