(press association.) CnmsTciimicii, August 3. This morning Mr Justice Dennis-, ton gavo judgment iu the case of Bailey v. Ross, mi ae.tion brought by the widow of the late Benjamin Bailey, of Timaru, lo bnvo David Mitchell Ross removed from the position of executor mid trithteu under the will of her husband; to have probato issued 10 herself in lieu of defendant, and to have a bi quest of tho moiety of deceased's properly on an alleged i-uoret trust to lies revoked on the ground that it did not express testator's int-ntion. It was contended thai R' ss had deceived Bailey as to the couteutn of the document he was signing, and had executed a secret trust when ho found he could not retain tho property himself, His Honor pronounced against the will, which was dated in 1888, revoked the probate thereof, and granted probate of the previous will dated in 1885, Cosis were given against the defendant.
