Clerk to the last meeting ot the

, Council!— 1 To His Worship the Mayi.r and Borough Councillors, Masterton.— Sirs. —In compliance with ins'rnc lions I beg to hand you my report on privato streets within tho Burouglr Seotion 23, of The Municipal Corporations Act, 1886, defines a private street to mean " any highway laid out onprivate property, but intended for, thejnso of tho public generally," and every street not coming within the definition of a public street (that is, or hereafter to be laid out within a borough by or with tho sanction of the Council") is also to "bo deemed to bo a privato street unless declared a public street by special order." Furthermore, Seotion 236 Btates that the power of tha Council to make any new street shall be exercised only by special order. In the following list of streets which come under the definition of private streets as giren above, I have shown the wards in which these streets are situated, and have cot a mark opposite Stose which have been made by the Borough (b) and a mark (p) against those made by privato owners, Certain of thteo streets ought now to be declared publicstreets by special order but it is necessary that a petition in that behalf should bo sent io by the persona described in Section 265, SubSection 2. The question of private streetß haa been before the Council time and again for years past, and legal advice bag been taken from Wellington, yet the matter is still left in considerable doubt, and I would suggest that the Counciltake thodeh'nitionsgiven above (3cction 281) into full consideration, with ut view to gulling the question finally set at rest, and afford a measure of relief in cases of hardship at present existing, I think a way out of thu difficulty may be found in the two definitions of prirnto streets, The list is a 8 follows: — EAST WARD. Herbert-street, 40 chains, connectf; Dison-street and Columba Road, Worksop Road, 40 chains, connecting Dixon-slrtet anil Columba Road, (B). Miriam-street, 14 chains, connecting Bannister-street and Worksop Road(p), Kirton-street, 14 chains, connecting Bannister-street and Worksop Road, Hessey-street, 7 chains, blindstreet (p), Sussex-street, It chains 60 links, : blind-street (p), WEST WAED.

M, Dixon-street, 40 chains, blindstreet, Bennington-strcet, 42} chains, blind-street, Fart of Albert-street, 12 chains, connecting Albert-street and Villastreet (b), Victoria-street, 20 chains, connecting Uhapel-streec and Villa-street (b), Fart of Junction-street, 5 chains, blind-street. (? Wrigloy-street). OUTKB WARD, Road, 37} chains, blindStreet. Cockbtirn-street, 40 chains, blindstreet, Donald-Btreet, 70 chains, connecting Junction-street »nd (no name). Vivian-street, 25 chains, connecting South Road and High-street, Solway-street, 20 chains, connecting High-street and Donald-street, (No name) Donald's Estate, 10 chains, connecting South Road and High-Btreet. Ditto, 6 chains, connecting South Road and High-street. Middle part ol Short-street, 17 chains, (i). Donald's new road, 85 chains, connecting West Bush Road and Boundary Road (p). Chamberlain-street, 60 ch&inß, connecting West Bush Boad and Upper Plain Road, Kibblewhite's Estate, 1. Marystreet, 5 chains, 2. William-street, S chains, outlot to Boundary-street, 3. Albert-street, 18 chains, connecting jjfoper Plain and toward Boundaryplreet, 4. Victoria-Btreet, 10 chains, (blind).
