THE WERAITE ROAD.
Hosking ut. Beetham, In the Masterton R.M, Court this morning, before Colonel Bober ts, B. !Vl., Mr Bunny made application that the second information Hosking v. Beetham, a charge of having voted as a member of the Masterton Road Board upon a question in which he wnn Interested, he heard before Justices of the Peace. The facta in the recond case were the same as those heard in the previous one. Under theso circumstances, he did not think Colonel Roberts would care to adjudicate, Mr Beard stated that he lwd received no notice that it was intended to make this application, The proper course to adopt was to adjourn the second case sine die until the appeal case was decided, He submitted that counsel had no right to ask that the case bo heard before Justices. Mr Bunny replied that he had not yet deoided to appeal in the first case. He was entitled to have the second information henrd before Justices. It would be a perfect farce to conduct the second case betore the same Bench. Mr Beard maintained that the proper course to adopt was to proceed with tho appeal. Colonel Roberts stated that if lie were to hear the second case he would arrive at precisely the same decision as in the first H- thought it desirable, therefore, that tho second case should be heard before another Bench. He would instruct the Clerk to summon a Bench of Justices. Mr Beard: Then will your Worship refuse to sit to-morrow ? Colonel Roberts: I will not say that. I will decide that point to-mor-row morning.
