' MABTERTON.-THURSDAY. ] (Before Messrs A. W. Renall and T. E. Price, J.P.'b) ALLEGED LABOENY. John M'Lennan was charged on the information of Sergeant M'Ardle with that he did in January lastfelonioußly ' steal,, tako and carry away one saddle of the value of £5, the property of, James Stewart, ' The acoused pleaded not guilty, Sorgeant M'Ardle stated that on tho 14th of January last the accused was in company with James Stewart at the Tehui Hotel. On the evening of that date tho saddle bad been removed from fitewart's home and had not sinco been seen until found in the whure of the accused. James Stewart, sworn, deposed: I am at prosent'employed on Bruncepetb. On or about 14th of January last I was in Temii, when t lost a saddle from my horse. I reported my loss to the police. Tho accused was in f my company on the night that I lost i the saddle, but left'after I discovered rnyloss. I mentionedmy losstoseveral persons on the station, About the 21st of May last I met the accused iq the atraet in Masterton and had a conversation with him about my loss, He asked me if I remembered losing my Baddleat Tenui, I replied" Veß," He asked me if I had heard anything about it, and I replied that \ had not, He said it was not lyipg rotting, as \ Bupposed, but had been in use since it was stolen, He said a person named had it, and was using it, He told mo that if Iwent there 1 would find it. On Monday morning last I caused a search warrant to be issued, and met the accused near the Taipo wbare at Langdale station. I spoke to him on different subjects, and during the conversation Constable Collerton came upon the scene. On seeing the constable tho accused said, II Stewart, I'll show you something in the whare that'll surprise yon; 1 have

your saddle there." The Constable I then asked bin* if he occupied the fff wbare and the accused replied," Ye?, worso luck." The search warrant was then' read to the accused,' who took Soytn itbe-'.'salddle! ab'd paid,''; Steward, -ibis is your saddle.'! The saddle produced' is the one I lost, Accused said he'fouiid tho saddle'in a gully tobinil —r—'n hpus'e,' and that'one side of it W all green and rptten' s]'bb he jpuo'd it.' There is do difference in the saddle now to ivbon I lost it. I value it at i's, and gave no person authority to remove it from my Horse.
