; MABTBRTON.-WEDNESDAY. (Before Mesarß W. H, Beetham and J, Biitoment, J.P.'a). FALSE WiETBNOES. Patrick Kearney was charged with obtaining certain goods.of the value of eleven shillings and threepence, from Cora E, Vile, by means of false pretences. Tho accused, who stated that ho was the Bon of a farmer residing at tha Hutt, pleaded not guilty to the charge, stating that he hud bought the articles for a surveyor. The Bench said it was satisfied the acciißod had obtained the articles under misrepresentation, He would be admitted to probation for ono month, ASSAULT. John Kite was charged with that ho did on the the 30th April last, assault Thomas F. Brenohley, of Miiuriceville. ; Mr Beard Appeared for the prosecution and Mr Pownall for defondant. Thomas F. Brenchley deposed: I mot tho accused, who had previously been working for mo, in (lie stroet on [ Saturday, the 30th April. He asked me, "How much did you pay my ' wife 1" I replied, "Onepound nineteon eightpenca and." He asked, " For how many days in the month.l" I replied, " thirty days in the month " He then raised his hand and said, " You ," and struok me on the heid. I went into Phillip's Hotel to get out of his road, and when I returned he chased me again and struck mo on the shoulder, A young man named Eagle interfered and stopped him By Mr Pownall: The row was about wages. 1 had my hands full and could not strike the accused. Michael O'Dea and Henry. Eagle gave corroborative evidence. For the defence it was argued that the case was a trumped up ono, The accused bad been provoked by Brenchley, and one was as much the aggressor as the other. Each party was ordered to pay his own costs, ERETAHUNA.-TUESDAY. (BeforeF. von Beden and A. Anderson, J.P.'B.) LARCENY OF AN OVERCOAT, Alexander Angus, alias Alex, Wilson, was charged by Constable Eoche with stealing an overcoat valued at £2 18s 6d the property of Wilfred Woolfe. W. Woolfe, sworn stated : I am a contractor working in the Eketahuna district. I was staying at the Eketahuna Hotel and left an overcoat in No 6 bedroom about three weeks ago, I went for it last Saturday week but could not find it, I valued it at £2 18s 6d, I next saw the coat in tho possession of Constable Roohe at my camp, I did not authorise anyone to take it, I informed the police that I had missed it. 1 know the accused. He has been working for me, I had a conversation in the presence of the accused that I had lost my coat, He did not Bay a word, Edward Elliston, sworn stated : I bought the overcoat produced from accused on the 30th April, He said he bad bought it at Jones' for £2 10s, I gave him 20s for it. John Sheehyn, sworn, stated : I am employed at the Ekotahuna Hotel, I knew the accused at Hunterville as Alexander Angus, It was last Xmas. I saw bim at the Eketahuna Hotel about a fortnight ago, Constablo Roohe sworn stated that on Sunday, May Bth, the accused went , to the police Btation and reported to him that ho had left his overcoat at Elliston's the day before. Elliston gavo him 5s on it. Ho said he bought it at Jones' for £2 los. Witness Baid | he could do nothing, that his only course was to summon Elliston for it. He said ho went with a man named I Dillon for it that morning, but Elliston wanted 20s. The coat was reported to witness as being Btolen on 1 tho Bth May and on the 14th he saw 1 Elliston wearing it, lie took posses- ' sion of the coat on Monday and arP rested tho accused at Mangaone. He , said the chap be bought the coat from had gone to Pahiatua. \ The accused, sworn, stated; I left ; Britt'e camp on Thursday week last. I camo to Eketnhuna and stayed at . Anderson's Hotel. On the Friday ' following, a young man came to me [ at the stables and asked me if 1 would buy a coat. I said 1 had a good oil- ! skin, and that I had not got much money. He said I could have it for ' 20s, he had given £2 10s at Jones' J for it. I only had 17s Gd on me but I would go and borrow ss. He gave 'me the'coat arid J took it to Elliston ' who gave me 10s and'said it'would ' cost me 10s W get it back.'
