Again Msital [Bit Telegraph- Pbess Association] Dunedik, April 8, At the Supreme Court, Ueary, a Peninsula settler, appealed against the decision of Mr Carew, R.M., in a case which Bowerman Bros, obtained judgment for the Picturesque Atlas Company. The contract was made in May, 1888. Pour parts were tendered in July of the 'same year, hut Geary refused to take moft than one, .which he paid for. Nothing was done until 22nd June, 189], when Bowerman Bros, attempted to deliver the whole of the remainder of the numbers, whioh he declined. Mr Justice Williams was satisfied that by ihe'Haybittla case the Magistrate should have nonsuited, and he allowed the appeal with costs. He absolutely declined to allow an appeal from his decision, on the ground that the amount involved was small, and thar there was no question of general importance. Au appeal would infliot hardship on the present appellant, as even if he was successful the costs would be greater than ho would be allowed.
