MASTERTON 7 ,-WEDNESDAY, (Before Mestjra W. H, Beothain and J. Butement, J.'aP.) LARCENY. Charles Bishop was charged on the information of Albert William Jensen with the larceny of ten bag.i of grass seed, of the value of 18. Mr I'owuall appeared for the presccution and Mr Beard for the defence. Mr Pownall briefly stated the iircumstances of the case. Albert William Jensen, sworn, loposedilaraa laborer residing at Vlauricevillo. I know the defendant, ,vlio was working for me up to (he irstof February. On the 3rd of February I was in Mastertoii, I gavo ho accused no authority to take iway my grass seed. In my alienee en bags of grass seed, of the value if £B, were taken. Eight bags we aken from one heap and two from .uotlicr, The sacks wero not marked. By Mr Beard : I engaged the noused on Bth January at a hilling an hour. He was working ip till the Ist of February, kept an account of the time worked iy Bishop on a separate sheet of iapar to that on which I kept that of he others. Bishop was the first ngaged by me. 1 cannot say why its name appears on a separate time heet, excepting that there was not oom on the sheet for the names of he lot, Bishop was never working smy partner, or mate. This I will ositively swear. I will swear I ever told any person he was working 'itli me. The accused never told me e had agreed to sell out his share in ie seed. Bishop said he wanted is money it once, and I offered to ivelrim an LO.U. for it. This he eolined to take, but offered to take le grass seed instead, He said he ould take the seed, but I said ho raid not, The information was id by me on the 10th February, ' ishop has made no attempt to get ivay to my knowledge. lam not ware that he surrendered himself to le police, The grass seed was tineaned, and would run about fifty-five junds to the bag. I have paid the u «her men cash for the work they have done, I have not paid the c accused his wages, I told him I " would pay him as soon as I sold the grass seed. I could not pay him, as ho took the grass seed. By Mr Pownall; I am quito certain I gave no authority to take away the grass seed. The accused had no interest in the contract. By the Bench'; Thoro were eight men on the job, Henry Jenson (my brother) was first cngagod, then flharles Bishop. I engaged all of the • men but one. I asked Bishop one " evening if he could get ine a man,, andhegot Louisa Bossitter, (laughter), Mr Eeard: That's a man, 1 understand. Tho witness: No, a woman I [laughter,] John Bossitter deposed that he had heard that the accused and Jensen were in partnership, He had seen tho accused taking away grass seed in the broad daylight. George Bartlett, manager for Mr Mackay, who let the contract to Jensen, stated that he had been placed in charge of iho grass seed cutting, and dealt only with Jensen, By Mr Beard; His only dealing was to receive the portion of the seed coming to hiin. He had received some of the soed from Bishop, Other witnesses were called and | _ gave corroborative evidence. The accused, on oath, denied the statement of Jensen that he was working for the latter, He took the grass seed by arrangement as his share of the proceeds of the contract. [Left Bitting.]
