Application for a Re-Hoarlng. ' In the Masterton A.M. Court this morning, before Messrs A, W. Renall . and T. E. Price, J.P.'s, Mr W. Q. Beard applied for a re-hearing of the case Bowerman Bros, v. Phil, lb will be remembered that on November 14th, 1891, judgment was given for) the plaintiffs by default. stated that owing to an error inTthe date affixed to the summons the defendanthad not.appeared when the case was called on. On the day ijadgment was .given ,the defendant was also suffering from influenza. Mr Pownall, for the plaintiffs, submitted that the defendant, seoing the error in the summons, should havo made inquiries as to the correct date. The error was no fault ot the plaintiffs. He pointed out further that it was three months since the case was heard and the defendant had since made a voluntary offer to pay £2 a month, Mr Beard replied that the offer hod beeu made under a mis • understanding, the defendant thinks ing that a re-hearing had been re» fused. Tho Bench decided to grant a re* hearing of the case, allowing coats to counsel for the plaintiff. Mr Beard applied that the re-hear-ing take place before tho Justices. Mr Pownall strongly objeoted...Ho considered the Resident should hear the case. After considerable argument their Worships stated that they were pre« pared to sit with tho Resident Magis* trate, and this course was agreed to, The fixing of the date for the rehearing was left with counsel.
