MABTERTON.-IRIDAY. (Before Messrs J, Butement and T. E. Price, J.P.'s) ASSAULT, i- Cuckoo Karaitiana was charged by Bobert Allen with an unprovoked assault on Febru .ry 6th, Mr Beard appeared for the plaintiff and Mr Skipper for the defendant, Mr Beard briefly stated the facts of the case. Mr Skipper: I would lite to know if Mr Allen is present, Mr Beard stated he would take what aotion he considered necessary regarding Mr Allen later on, Mr Skipper: I ask because I am led to believe that the plaintiff does not wish to proceed with the case. Mr Beard replied that he had in* fstruotions to proceed, The Bench decided to hear the " oase, Rhoderick M'Kenzie deposed that he was in the Club Hotel on February Oth, when he saw one Patrick Carr touch Cuckoo Karaitiana on the back of the hat with a whip, Cuckoo turned round, and Mr Allen, who . • waspreEenl,said, "That's nothing, hemeansnoharm," whereupon the Maori drew his hand down Alton's face, There was no provocation on the part of Allen, By Mr Skipper; There was no actual bbw struck, The Maori drew his hand down Allen's face and said, " How would you like that ?" By the Bench : He saw no marks on thoface of Allen afterwards. At this stage Mr Beard asked for an adjournment of the case to allow of Mr Allen's attendance. Mr Allen was now in bed suffering from rhou*. rnatio gout, Mr Skipper submitted that if an A adjournment was granted, costs ifik should be allowed. The case was a "trivialone, and should never have been brought into Court, There was no evidence of an assault, Unless there was stronger evidence to be given than that adduced tho case should be dismissed. Mr Beard contended that an actual assault had been proved. He had no stronger evidence to bring than that of Mr McKenzie. Mr Skipper said he would prefer that the case be proceeded with. Cuckoo Karaitiana, sworn, stated he was in the Club Hotel on February Gtb and saw. Allen there. Carr struck him on tho head with a stick whilst he was drinking and he got angry. Allen said "Oh, that's nothing," whereupon witness became i very wild and put his hand in Allen's faoe, but did not touch him, Allen then said he would get a policeman, . and would summon witness for striking him, Witness replied that he did not strike him. By Mr Beard; He wanted to strike £ Carr, but was prevented from doing so. He struck Allen because he interfered. A fine of 5s and costs was inflicted, BTIUYINQ CATM, William Iggulden, for allowing four horses to stray within the Borough, was fined 5s and 2s costs. Thomas P. Lett pleaded guilty to , allowing five horses to stray, He stated, however, that lie had paid poundage fees already and it was not üßual for the Inspector to summon as well as impound, The Inspector had called upon him and asked him what poundage fees he had paid. He told him and he replied, " Oh, you ought to lave paid more than that," Inspector Ingram stated that he had been instructed by the Borough

Council to take prompt action to prevent horses from straying, In this case the poundage-fee had been paid, Mr Butement: As.the poundage fee has been paid the case is dismissed. William Iggulden, 'William Neill aud Edward Braggins, for allowing their cattle to be at large, were ordered to pay the costs of the Court, 7s.
