• cojnmiiß, Mfi This waa 8; motion on notice on behalf of the Attorney-General for a writ of certiorari to "the .members of the Wanganui licensing Committee to remqve into the Supreme Court all proceedings, documents, entries and*" records in connection with certain appiicatiouß made to'such Licensing Cpmraittee by William Qdgers and Edward McElwain, both of Wanganui, publicans, for renewal of pub!i« canB 1 licenses, and in connection with the refusal of Buch application by the Committee on the 18th of June, 1891, for the purpose of euoh proceedings, etc., being examined, and the decisions of the Con.mittee being quashed, Tho grounds stated in the notice of motion were four, namely ;-lat, That at the, time •of the decision!, three of the Committee, (namely Messrs Basset*, and Jones and the Ref James Treadwell) ■■ were interested and biassed, insetauob. as they were under a plddge to those who eleated them, to refuse the applications.. 2nd. . That at the time ef the decjgfra the same three members interested and biassed, inasmuch as they were under a pledge to thoea who electe'd them to close at least fire publichousea in the (own of Wanganui under any oircum. stances. 3rd. That at the time of the decision Mr Bassett was interested in the matter for. decision, inasmuch a|. he was then a. holder of Wanganui Borough debentures ohargeable on tho borough fund to. which all license fs9l were payable. / 4th. • That at tho time of the decisions Mr Bassett was not in foot a member of the Committee (although .he took part in thedeci* sions), inasmuch as he was. not when elected a ratepayer in the Wanganui Licensing district, and was not, there* fore, competent to bold office, The evidence in the case was taken before tho Chief Justice at Wanganui at the sittings of the Bupreme Court held there in October last. F, Fitzgerald and W.
