I saw hi,in I in Anderson'a Hotel, firat: in the diniug-rootn, then in the passage by the bur. He" changed: another one-after tea, When he returned before tea.he gave me bis white trousers, which be had changed, to keep, :•" Mr Brenmuhl gave' evidence as to the accused imyiiig a pair of trousers and a hat, giving a sovereign, in payment. ..--.,■ .': A R, Dowdswell, sworn, stated that he saw the accused • at the end -of Brenmuhl's store. He was stooping down close to some boards, Constable Stewart deposed;, I recollect December 26th. At 7, p.nvj I accompanied CoostHble Jttoache and) accused to Brenmuhl's store to, search for the money. The acousod -, Jiu'd forgotten the place and could'nbt find the purse. 'The accused said he had taken.tho mppey.out of the purse but had lofi a paperor two in it. He bad put the purse under some boards. • Constable Roache, sworn,' stated: About 4.80 p.m. on the 25th December, J. W. Smith informed me ,that bo bad lost his parse and the money ' contained in the information. From ' information received I proceeded to the. Railway Hotel about 9 p.m. I found the accused there drunk, I arrested hiiu and reed the oharge, viz., larceny of money fromi Smith, I searched hisi and found 8 sovb and £1 13s in silver, I brought him to the lock-up, but he was too drunk to understand anything., 1 read the charge again next moniing, I entered the cell about 2 p.m. with Lars Hansen. The latter asked him "What mado you do it," Prisoner replied, " 111 tell you all about it. The Inan was asleep with the purso in his hand, and I took it out." The prisoner reserved his defence, and was committed for trial at tbo next , sitting of tho Supremo Court in Wellington.
