| G, W. Phillips v. J. Keeghau. No appearance of defendant. Claim for wages. Judgment for plaintiff, with costs, 20s. W. G. Hayward v. H. Burling, junr. W. G. Beard for defendant. Claim for survey work done last August. W. G. Hay ward deposed: I received a letter from Mr Burling, asking me to go out and survey 500 acres of bush hnd at Is per acre or £1 per day. I accepted the offer at per acre, and went out on a Monday morning. Mr Beard maintained that as Mr Burling junr, was only acting for his lather, the case could not go on as the wrong person had been summoned. The case was adjourned.

Thomas Maunaell v. Ernest Eades. —Claim for £5, balance on two cows supplied. Mr Maansell deposed that he sold tiip defendant two cows in April last with the option of taking three, the twq at £ls, or three at £lB. Defendant tool* two cows, for which he paid £lO on deposit.' Now he refused to pay the balance. The defendant stated: I went oyer jn April to buy the cattle. ' I offered £9 for the one and £6 for the other, and paid £IQ on deposit. The cow did not produce more than of butter a week, and the ,cpw was very wild. I could not keep her at home, as she jumped all the fences about the place. 1 offered tp exphango the guaranteed cow for the £$ cow. Daniel McGill gave evidence as to the quiet nature of the cow. Mr Street gave evidence for defendant. He was acquainted with the cow. She was far from being quiet and was about eight years old. He had seen her in milk, and she only yeilded about 4qts. He would say the value of the cow was about £4.

Judgment for plaintiff for £2, with osts 10s.
