A PICTURESQUE ATLAS CASE.

Bowerman Bros, are proceeding against subscribers to the Picturesque Atlas with varying success. JL). Strange, a well known coffee merchant, resisted payment because the books were not delivered, and succeeded, the plaintiff being cast ia costs. It appeared that the books were lefc in the entrance to Strange's office by Bowerman, and disappeared. To-day the firm sued John Scott. Jle declared that he never signed any order for (he book ; that when the canvasser Metcalfe, showed him pictures of Australia he said he had no interest in other colonies, theugh he might take a similar work in New Zealand if published. That, Metcalfe stated, was his own feeling, and he was trying to get support for such a work. He asked Scott to sign the list of patrons, which be did. Scott declared that the list produced was not the same, and described the differences. He also affirmed that he never 3igned any order. A bank official deposed that to the best of his belief the signatures were all Scott's. Mr Rawson, R.M., gave judgment for the defendant on the ground that he had been fraudulently induced to sign an order for a Pic turesque Atlas of Australia, at the time believing he was signing a patron's list for similar works referring to New Zealand, and that the canvasser represented that Scott would have an opportunity to inspect the work before subscribing for it. Leave to appeal was refused on the ground that the decision was on a matter of fact. Metcalfe was not produced.
