Dunedin, September 25

At the Supreme Court yesterday, .las. Geo. Stracban sued W. A. Stout, claiming £3OO danioges for alleged slander, in the following words:—"lf be (plaintifl) refused to go away from the colony he would bo hrauded as ft felon, and his children also, should he have any, unless he (defendant) could keep the prosecution back." The defence was a general denial, and the plea that it the words were spoken it was in the course of a long and confidential conversation with plaintiffs wife and mother-in-law. Defendant is the brother-in-law of the plaintiff, the latter being the son of William JStrachan, deceased. The business aad_ beeu_ came_d on bya^jg plaintiff had been guilty of as a servant warned him to leave Colony to avoid prosecution. Strachan wont away, but returned after some time. Stout, who was solicitor to the company :nto which the business was formed, had been consulted by the receiver, who became the managing director, as to whether proceedings should be taken. To avoid prosecuting, Stout asked for an interview with plaintiff's wife and mother-in-law, so that they could use their influence to induce him to go away, and it was in this interview that the words are alleged to have been spoken. After a good deal of evidence had been taken, Mr Fraser, who appeared for the plaintiff, abandoned the case, and a verdict was given for th<s defendant.
