LICENSING PETITION
THE DECISION
|/ THE ELECTION VOID. In Court this afternoon ' Colonel Robertß, R.M., gave his decision in the Masterton Borough jjjfc Licensing petition case. He thought W the appointment of the Returning 4 Officer was sufficient, and did not i- : defeat the fairness of the election. As * to the nomination forms, he considered that the provisions of the Act had not been complied with, and the nomination papers were invalid. The words "elector " and " candidate" were essential, and had not been inserted. Mr Dalrymple's nomination was quite 'i ljgal. He did not consider the roll |_i a prefer one. There was an r irregularity in the taking of the local option poli, I'lH he did not think this upset the fairness of tile election. Taking everything into account he had no option but to declare the election void.
Messrs Pownall and Beard received judgment for the petitioners and Mr Bunny for the committee. No costs were aliowed.
