The Dummyiam Case, [By-Telegraph} (United Press Association.). Wklld?3ton, Monday. The Court opened this moraine, Chief Justice Prendergast presiding. After reviewing at length the evidence takeain s theJower.Gourt, the learned Judge* Bid that although he had gone very carefully through' the Land Act he could find nothing expressed in its provisions to prevent, anyone taking tip land for another. This, however, was a point of law, and he directed the Grand Jury, if they thought the facts warranted it, to bring in a Bill against Mr PhilHpsi; and leave the point for argument when the case came before the Common Jury. His Honor remarked that the Legislature were evidently under the impression that they had made a provision.in the Act to prevent persons, from obtaining land on deferred payment or perpetual lease not exclusively for their own use, as section 18 had fixed the penalty to be infused in the case of anyone taking up land other than for his own use. .. - , Latkb.
