CARTERTON—TUESDAY.

(Before Colonel Roberts, R.M.)

Thos. Ray v. W. B. Allen. Case heard at last sitting of the Court. Judgment given for plaintiff for .£6O, costs, 445, and solicitor's fees 635. Mr Acheson gave notice for an appeal. W. Caddwallader v. Wiley, and vice versa. Mr Acheson for Cadwallader and Mr Beard for Wiley. The plaintiff claimed £6 15s for nine white pina trees which the defendant took and cut up into shingles. All the plaintiff had received for the trees was 1000 shingles, valued at 7s ea.

Plaintiff, on oath, deposed he did not agree to let defendant have the trees for 5s each. He told him he could have the trees for the samp price that he paid Mr Goodin. R. Goodin stated that the trees were quite equal to what the defendant had had from him and were worth from 12s to 15s each.

The defendant Wiley and his brother, Hamilton Wiley, gave their version of the affair.

Carl Jansen also gave evidence in the case, corroborative of the previous witnesses.

Mrs Cadwallader, wife of the plaintiff, deposed to the arrangement made with the defendant in respect to the shingles. John Thomas deposed that he had heard the parties say that there had been no stipulated price about the trees, but that Wiley said he was quite willing to pay 5s a tree. Judgment for Cadwallader for £2 ss, and for Wiley for £2l2s 6d, witnesses expenses 17s, Court costs 16s, anil solicitors fees 21s ■ Wiley v Cadwaller, Court costs 9a.
