An interestipg legal point was raised at" the Resident Magistrate's Court to-day by Dr Laishley, in a case in which a man named Richard Webster sued A. R. Greenway, a solicitor (who has achieved a certain notoriety), for £34 14s for work doneThe address at which the summons wa».served on defendant was Asbburn Hall, a lunatic asylum at Dunedin. This service was ruhd to be a good one on its face. Dr Laishly sub mitsed that Dr Giles, the Resident Magistrate, bad no jurisdiction, as the Court had no power to hear a case against a lunatic, who should appear by his guardian ad libitum. If he broke out of the the summons, he hunted down by the pouceHrmiif he did reach the Court he could not be sworn, being a lunatic. Such a service of a summons therefore was a farce. Dr Laishly further argued that as the defendant was in an asylum because of h&bitual drunkenness, the pro visions of the ordinary law in regard to drunkenness did not apply to him. His Worship adjourned the case for three weeks.
