Wm. Ridgway v. James Ecid. Mr Beard for defendant. This was a case in which; itlie plaintiff (being rauger for the Taratahi-Oartorton Road Board) sued the:defendant'for damages for rescuing certain cattle rom liira on the 3rd day of October, when he had them in bis charge -for the purpose of impounding them. Thos. Ridgway, on oath.stated that ho saw thecattle on the day. mentioned grazing alongside of the road and was assisting tho plaintiff to drive them* to the pound, whon a, : girl named Gertie Shaw came and tried to drivo them away. IV defendant wns not near'the place when the cattle wei'6 taken possession of by the ranger, but camo running, up shurtly after and rescued .the ; cattle and refused to pay for them, tolling the ranger that he might summons him, By Mr Beard: He saw the girl (Gertie Bhavy) in. the garden with'a baby in her arms and as soon »b she saw the ranger with the cattle she put the baby down and ran to the cattle and tried to get possession of them, when Mr Reid came up and took possessicn of them, James Reid, being sworn, deposed that the cows on the morning stated were being driven from the .stockyard to the paddock, when the ranger came and attempted to drive them away from the girl, Gertio Shaw, who had them in hor charge for the purpose of driving them to the paddock, Gertrude Shaw deposed that she was driving the cows from the stock yard to the paddock, when the ranger attempted to drive the cows away from her and refused to allow her to drive them. The information was dismissed.
