■ ..uAuoKtAXD, September 10. ; -.' Henry Funcke was indioied to-day at the Supreme Court for the murder of Constable Neil MoLcod at Mangawhare r on, the SOUi of July. The prisoner's' 1 counsel objected on the ground that Funcke was insane and unable to plead or comprehend the proceedings, The jury were accord l ingly Iworii in from the bystanders to try the question of tlie prisoner's sanity. At the present lime Drs King and Moirdeposad that Funke was insane ; Dr Philson, on the other hand, swoft that lie was perfectly sane, and a man of more than ordiuary intelligence; Mr Reston, the chief gaoler at Mount Eden prison, and Warder Russell gave evidence to the effect that the. accused had appeared to them to be quite rational, The jury were for a long time unable to agree but at length returned a verdict that the accused' was" sane. The trial will therefore proceed to-morrow.-- '.
