The defendants ndmitteil publication 1 but denied malice. They claimed that the article "wm bona fido'comment on a matter of public interest, and pleaded, further/ that it was true,, the plaintiffs having ■ wilfully mailo and circulated false statements respecting Mr Renall and Mr Heron's candidature. They called evidence as follows:—James Brown, a reporter on the W.UHAIUVA Dam, deposed to the accuracy of his report of what Mr Renall had said, namely, that if any of tho old Councillors would come forward " he would not oppose them;" and "he would not be nominated in opposition to them," Mr Hogg, who was reporting for the Star, took no notes, but just stood beside tho table. Understood Mr Renall to say ho would not oppose an old Councillor, Re-examined: Did not hoar the words " support" or.. " assist" used by Mr Renall; " assist" might have been used, but lie didn't remember it, By Mr Bell; Thought when he saw *lio titar that Mr.Hogg had gone further than Mr Renall.
