Over 1200 rams were entered, and as many owes, The biddingfor the fame wasonly fair, though some passed off by well known breeders, fetohing an average of S to 7 guineas. • A fiiie stud ram of W. Wilson; of Wbeniia'. kura, fetched tho top price of 81J guineas, Mr Gaisford, of Napier, being the purchaser. Buyers were also present from tho Boutli island, Mr Reid, of Oamarn, securing several fine sheep.

The Bank ot New Zaaland, whu Van the principal creditor, (their claim amount' ing to several thousands), ateo applied under section 171 of the Act to bare tho baukrupt convicted fur a breach of provisions of aubscollon 5 of thai section, viz., in putting the creditors 10 unnecessary expeuse by setting np a fiivoloua defonco to thu action of the Bank, in eorvipj; him with a writ in satisfaction uf their claim. Mr Gully, for (he bankrupt, submitted that the evidenco-of the third party could not be taken In support of a con--vlctlon, and tho bankrupt Could nut bo convicted out of his own moulli, Mr Statiurd, for the Bank of New Zealand, argued that.the evidenco of a third party was admissible,* and Judge Richmond inclined to that opinion, lie consulted the Chiof Justice nn tho point and he tOjk the eamo view of tho qmition, although, he onid he was not by any. means clear about It.
