The Wairarapa Daily THURSDAY, JANUARY 30, 1890. The Chattel Transfer Act.

A measure .- termed the Chattel Transfer Act came into operation on oho first of tbis month, The new act is a simplification of the law as previously existing with respect to liens ■ and securities, and from this point of view will commend itself to the commercial 'community. Under the new Act tho period for registration has been altered, and it now varies from ten to twenty-one days, according as the instrument is executed within fifty miles or over fifty miles from tho place of registration, the period for example in Wellington would be ten days, and in Masterton twenty-one. Priority, however, is given in tho Act to registered instruments over unregistered ones, and for this reason it is probable that in most instances registration will be prompt, and the full time allowed by the Act will not bo taken advantage of, In England registration is compulsory, and the chances of a debtor concealing bis embarrassments from his creditors is consequently considerably less than they are in this community, though even here wool liens have been invalid unless registered. But under the Chattels Transfer Act only a registered security is Valid in the case of a bankruptcy or of'an execution, or as agiinst some oth'or registered instrument. There is, too, a proviso which protects bdnafulc purchasers of grain, wool, or stock, from tho operation of unregistered securities, unless express notice has been given of the existonce of suoh liens. The Christchurch Press o'omraenting upon the new Act, expresses an opinion that.it would be a much happier state of things if securities in personal property were loss ; common in this Colony than they are, However, the lawyers of the House of Bepresentatives are entitled to some orodit for having condensed and simplified the legislatioH which regulates the dealings between borrowers and lenders. Lot us hope 'tint under the new Act there may h fewer openings for chicanery than have hitherto existed, People will still go borrowing and sorrowing, but the existence of uniform, clear, and intelligible provisions for all classes of liens on personal'securities will he an undoubted benefit.
