RAILWAY BYLAWS.

Napier, July 18, A curious point was raised by the y counsel for the defence in the prosecution for a breach of the railway bylaws. Of course tho Commissioners wero the nominal prosecutors. Clause 8 of the Act under which they were appointed provides that tho major portion of the Act shall remain in abeyance until brought into force by an Order in Council, published in the Gazette. No such order has been published, and the magistrate upheld the objection and dismissed tho sumOthers have previously boon fined under the same bylaw.
