Alfredton Road District.
A meeting of the Eoad Board was held on April 9th, Present—Messrs Kebbell (chairman), Cross, Dunn, Benton, and J. Smith. The minutes of the previous meeting were read and confirmed.
1 '. Correspondence inwards was read as Mows:—From County Council, re closing roads in-winter. From same, enclosing memorial, re legali izing roads'in use. From Bank, of New Zealand, acknowledging cheques of £6lßs 7d and £7 6s lOd, and 1 enclosing certificate of balance for audit. From Mrs E. Saifc, requesting 1 to know when the order on 0, E. 0. Smith would be paid. From Mr S. Bacon, requesting the Board to allow him to out timber on the street adjoining his place, and requesting his name to be put on the roll, as owner and occupier of Lot 6, Block XII, Mangaone. From Mr W. G. Beard, in answer to the Clerk's letter re witnesses in the suit, Phillips versus Alfredton Road Board. From County Clerk, enclosing rotu'rii of Roads and Highway Districts, to be filled in and returned by June 14th. From.W. 6. Beard, re the decision of the jury on Phillips' case, and requesting 'ohequo for j£6o 16s, the amount of costs and damage? awarded. It was resolved that the Board is decidedly opposed' to any further restrictions than those impos'ed'by the present wheel tire by-laws; that the Chairman be empowered to sign the memorialI;'' 1 ;'' that Mrs E. ! Sait hf paid at once ['that the sum of L6016s he sent to W.. G. Beard. After some discussion whether the whole Board should pay the costs and damages, awarded, Mr Dunn said it was the opinion of the settlers whose interest L he represented, that in order'tb'prevent any. further olaimß of this sort, tho To Hoo Ward should pay all costs incurred hi connection with the case, more especially as some of the settlers in that Ward had encouraged Mr .Phillips to enforce his claim.';He was. sorry that the innocent would suffer as"well as the guilty, but he would .move: That the Te Hoe ward bear "all costs and damages'awarded in this mattor in connection with same. After some further discussion the Chairman moved as air amendment that the costs and damages be borne by the ! whole district. For the amendment: ■ Messrs Cross and Kebbell, against, Messrs Dunn, Benton and Smith. ' For the motion: Messrs Dunn, ' Bentpn and. Smith, : against Messrs : Cross and Kebbell. The Chairman ■ declared the motion carried;, That a ' surveyor be employed on the deviation at Phillips' to tako it under the Public Works Act to survey • and ' make out plans of same, and that the matter, be left in the hands Of the I Chairman, and that he be authorised to take all steps necessary in the matter. .■ Tendpra were .opened for: erecting and finding all material} for • Road Board office as under: George j Benton, £29105;. accepted jA, Dun- ' l stall, £BBlos,declined;!.
