Anketell, claim £1 3s Id, No appearance of defendant. Henry Colt was 1 sworn to explain in the deaf and dumb alphabet, the evidence of plaintiff, Judgment for amount and costs 7s, J. C. Crawford v J. Bagge, adjourned till to-morrow at 2.o'clock. W. Wagland v C. Bennington. Judgment summons £9 17s Cd, Mr Beard for plaintiff. No' appearance of defendant.. Order made for one half, to be paid on service of the order, and the balance one month from date, in default 7 days imprisonment.

Defendant admitted the claim subject to a set-off of M, but had failed to give plaintiffs solicitor notice ol the set-off judgment was entered for the amount claimed, execution to be stayed until the cross action was decided. J. Torrey vC. A. Pownall. Claim £ll6s for three day's expenses as witness in a case in which he was subpoenaed by warrant issued through plaintiff. Cross-examined by defendant: Had applied to Mr Pownall for and he said as soon as the natives paid the money he would pay him. • Tawaio Tetaio deposed that he was a plaintiff in a case against Stevens in which Torrey was witness, aud in attendance for three days as a witness fur him, Ho asked him to attend as a witnoss.Mr Pownall was his solicitor, and he had given him the money to pay all the witnesses expenses including Torrey's. Did not.know how much Torrey claimed, He paid the costs as ordered by the Court. Nothing was said to him by Mr Pownall about paying Torrey. Had received 1 an account from Mr Pownall of what monies' he had received, Ho expected to havo to pay Torrey, .arid j considered the money paid to Mr Pownall included all expenses and ! that he had no more to pay. ' . . Cross • examined'by defendant. ' Had paid £l2 to him altogether ] including M for witnesses expenses ' which he-had to pay into Court I before the case could be goueon with. ' Torrey had asked him several times ' for the money, and he had told him ! fc'go to his solicitor.-.
