Christopher Tait v, John Fabian.— Application undorSectionß2/Fenoing Act, 1881, t& fix a boundary line between their properties at Kopuaranga, Mr Beard for plaintiff, Mr Skipper for defendant. The survey lino made.by Mr Frazi in August, 1888, was agreed to by both parlies as the boundary lino of their properties. Considerable arguments ens'ued as to which party should bear the cost of the proseut action. Ultimately His Worship granted the application prayed for and that the cost of Court 7s bVdivided, each party paying their own : " "solicitor's fee. The whole matter of cost and passing of fencing be loft, subject to the decision of Mr 0. H. Osbbi'rie, Dreyertown,- which decision will; be final. The whole work to he completed on or before the Ist December, 1888. The fence already erected by plaintiff to be sbiftSd at bia own cost.
