THE FRENCH ESCAPEES. Wellington, Friday. At the Supreme Court to-day, before .Tnstioe Eiohmond, Mr Jellicoe applied for a habeas corpus to prevent the extradition pf the escapee Gasparini. He contended there was nothing on the face of the warrant to show jurisdiction. It did not appear on the warrant which give the Governor jurisdiction. It must be shown that tli; prisoner was a convict undergoing sentence.- His Honor said there was nothing in that excuse because tho statutory form had been pursued ij far as applicable. Mr Jellicoe said such cases were very rare, there wero no cases reported in the law books, and in the absence of authority the warrant should conform with the common law ns well as the statutory. Again under the treaty Of extradition the requisition must come from the Governor or chief authority of the Colony from which- it was alleged he escaped. This was not so as the requisition was sigued by tho French oonsul of New Zealand. The case is proceeding. Mr Jellicoe, after reviewing his evidence, contended that the documents put in evidence beforo the acting governor were unauthenticated, being merely copies of a copy, and asked His Honor to grant rule nisi, a also that an order for the requisition might be made to have it brought into Court for the purpose of being quashed, His Honor reserved his decision.
