A Peculiar Case.
R. Shannon v. D. Toohill.—Claim, £3 for an overcoat and cap, and a handkerchief detained by the defendant, and £2 for damages; total, £5. Mr Eunny appeared for the plaintiff, and Mr Pownall for the defendant.
The evidence showed that the plaintiff, who is a corn doctor or chiropedist; was at the defendant's hotel on a certain occasion, when the barmaid
broke a window with what was described as her "bustle," owing to, it was stated, the plaintiff pushing her,' She then demanded payment of the damage from the plaintiff, saying she was responsible to tho landlotd for it, and upon.'his declining to give toy recompense for the property destroyeop his belongings weie hence the present action, Counsel entered with considerable warmth into a discussion as to whether the defendant was justified by law in holding the articles and looking upon them as covered by a lien for the amount of damage done. The Bench ruled thaf the property could not be held in the wanner indicated, and that the coat &c. should lie returned to plaintiff, or in default £3 should be paid by defendant. No costs were allowed, each party to. pay its own.
The other cases dealt with were McLeod v C. Fabian.—Claim £l9 lis 8d for half cost of a party-fence. Judgment was given for plaintiff for £ls Bs, in addition to £2 12a paid into Court, being at the rate of 18s a chain, instead of £1 as claimed, defendant to pay costH,
Mary. Conroy vT. A. Lyons.—Claim 41s for wages. . This was :us application ou a previously summons, and His Worship ordered immediate payment, or that in deficit, the defendant should be iinprisonedfStj' seven days,
