The claim wan one for £IOO made by Thomas of Horokiwi, against a neighbor named James Butler for damage sustained owing to the npread of a firo which was alleged to have been lighted by the latter on his own land on the 6th Febrwry. The flame! destroyed 18 acres of the plaintiff's grasH, bosidei about four acres of native scrub which had been left standing as;Bhelter. Plaintiff wae unable to swear that the fire, which did the damage was lighted by'defendant. Thedefenco was that the.fire did not originate on defendant's land, but spread twit from other adjacent properties. Evidence having been hoard at great length, his Worship intimated that he was-inclined to the latter view, but reserved- his decision until next day,
