OARTERTON-rjESDAY. (Before Mr Von Simmer, R.M. and B. Bovs, J.P.) W. Brewster juu., v W. Brewster sen., (no appearance of defendant)-An appli--cation for a prohibition order. • Tho order was granted for one year to take effect in the Carterton and Taratahi districte. . Riohard Hoppy was charged by John Vouroffwith breaking a pane of glass in a window in a house in his occnpation, tho value of the damago being laid at ss. Thomas M. Cave stated t|iat he did not see the acousod throw tho stones. The case was dismissed, Hia Worship-intimat-ing that in case of any such chargo as this one being proved the offonders would be severely punished. C, H. Giles v. J. Pyke.-Dobfc £9 9s. Mr Sandilands for plaintiff, Mr Beard M defendant, A set off of £lO 10s was put in by defendant, which was refused by plaintiff. In answer to Mr Sandilands the defendant stated that he and P. Sheeriu were in partnership at the time but that the entire •■ horsß belonged to him. In answer to Mr Board the defendant stated that he had paid the plaintiff an account since this sum of £!) 9s had been owing. J. Buckendgo deposed that he was present at tho time of the Bervice of the horse, and also that tho plaintiff told him that he took the eorvico of the horse for an account which Sheerin owed him. C. H. Giles deposed that at the timo of the services of tho horse Pike and Sheerin woro iu partnership, A t the time Sheerin was indebted to him, and that was the reason why lie put his mares to tho horse. He had no doubt but what tho mares were served, but neither of them proved in foal, The amount now sued for was outside of that arrangement altogether. Judgment for £A 19s and coßts £llßs.
