R.M. COURT.
MASTERTON-THIS DAY. (Before H, A. Stratford, R.M.) CIVIL OASES. Riohard Kitchen v A. Spackman;— Claim for wages L 7. Plaintiff stated that he was employed by defendant at L2 a week as groom, and he had received L 5 on account of wages. Defendant denied making any arrangements with the plaintiff, and considered that 25b a week was quite aufliciont for the amount of work done by him. Judgment for Lslos, and costs 10s. His Worship in giving judgment, drow attention to the habit of. masters in employing servants without stating the wages to be paid. The masters havo no right to keep a servant employed several weeks, and then dismiss him without paying proper wages. If servants are insolent, or refuses to work, the Court would then uphold the action of their employers in dismissing them without paying them. An indifferent man must be paid, as well as a good one, unless complaints-are mado against him. , R. McGilvray v A. Solby.—Claim for goods supplied to defendant's men, to the amount of Lsl6s Bd. Plaintiff stated that the goods were supplied on the verbal ordor of defendant, who promised to seo them paid for, Richard Taafe, who made suro of his expenses (30s) before giving evidence, deposed that he went to plaintiffs store with Mr Solby, but did not hear any promise mado to pay for goods. Selby merely said he owed witness some money. He wrote to plaintiff, and told hint he should pay in a few weeks, but if he pushed him into Court ho should throw indebtedness on to Selby. Plaintiff- had applied to witness for payment of the account Beveral times, some of which had been paid, The balance was to bo paid on completion of their present job. Defendant denied giving plaintiff authority to supply tho men in his name. He told him the men had money coming to them for work they had dono, and appeared honest, straightforward men. Plaintiff was nonsuited with costs, His Wwship pointing out 'that no order to goods can be binding unless givon in writing. Defendant wa3 allowed 303 for expenses.. ■(Left Siihng.)
