(Beforo H. A. Stratford. R.M.) a ALLEGED SLY GROG SELLING,, William Blinkhorne was charged with • selling certain spirituousliquors athiardjft dence, known at BlinkhorneV BoardiftgT House, without being licensed to do so. Mr Bunny appeared for the defendant, and at his request the witnesses were ordered out of Court.
Henry McArdle, Police Sergeant, sworn, said that on Thursday, 13th inst., he proceeded to the House of defendant, situated at Maurice'ville. He arrived there with ConstablesHealy and Ouliinano at 4 o'clock that afternoon. Just outside the door they met two young men coming out; one appeared fco'he very muoh under the influence of drink. On entering the house they found another man Bitting by the fire, who rose and endeavored to leave the house when they entered,: but: was too drunk to do so, He gave his name as Patrick Phelan or Wheelan, Mrs Blinkhurne was the only person beloriging to the house that witness saw. He- etatedl' his business, and produced a search warrant, and asked if she had any liquor in the house, and if so, where it was. In conseqence of what she said he searched a pantry, and'found on one shelf a botfck containing rum, and another brandy, m one other containing rum. Mr BlinFj home then arrived, and witness askew him if there was any other drink in the® house, and asked him where it was, but lie said there was no more. On searching a back chaff shed room, witness found under some bags of chaff several empty beer cases, and one case containing 38 bottles of beer, Around the premises there were various heaps of empty bottles, more than would be found at the back of auy.hotel in Masterton, andseveral empty beer and spirit cases. ' Mr Bunny objected to the evidence, but his objection was not sustained. ' By the Court: There were from 9to 12 dozen empty bottles; by virtue of the warrant he took possession of two bottles containing rum, and five of brandy, and thirty eight bottles of beer. The bottles were more or less used from. Cross examined;by_Mr:Buniriyj:He' did not know what the empty, bottles contained when full. The case of beer was in a concealed position in a back store. John'Cullinane and JohnHealy, Policejj constables corroborated the evidence the last witness., Patriok Phelan gave evidence to the affect that he purchased. several articles' ,J from the defendantathis bouse, for which he paid.
