R.M. COURT.
GREYTOWN—WEDNESDAY. (Before H. A. Stratford, R.M.) ' ASSAULT. William Pole was charged with having assaulted J, Ternefski. The evidence went to show that accused went to Ternefski's house at ten o'clock at night, and iisked whether lie was at home. Ternefski was in bed at the time, but got up and went to the door, saying, " Yes, I'm here; what de you want ?" Defendant said, "Why have you been.following me abouttheselasttwo orthreedaysTernefski replied, " Ihave not followed you." Defendant then struck him and felled him to the ground, and struck him twice while down. His Worship considered that a violent and unprovoked assault had been committed He was very ; much inclined to send Pole to gaol without the option of a fine; but as he knew nothing else about him, he would order him to pay a fine of 40s, coats Vs, and counsel's fee 21s ; with the alternative of seven days imprisonment ; half the fine to go to defendant. CIVIL. Four civil cases that had been set down : for hearing, were settled out of Court.
