The adjourned examination u of this bankrupt was proceeded with, counsel on both sides accepting the.evidence formerly given .before Judge Davy. Mr Beard appeared fqr tjjie creditors and Mr Bunny fertile Of|ciai'A'st'jgnee, The bankrupt did not respond to his natne when called. Mr Beard expressed his intention of calling evidence to criminate the debtor under the penal clauses of the'Aot. The.Court thought it would be a disadvantage to the debtor to be absent when such evidence was taken against him. Mr Bunny did not think that tho bankrupt had had an intimation of the nature of the proceedings to be taken against him that day. Mr Beard said the debtor had not been taken by surprise, a previous intimation of criminal proceedings bavjng been given to him at the first examination. The Court jsaid it was reluctant to take evidence at the present stage unless it was convinced that defendant was aware that evidence of a criminating character was about to be brought against him at theipresent sitting. The examination would be adjourned till thel7thinst.at9a.nl. ...
